Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you and excelerAItor ("we," "us," or "our") governing your access to and use of the excelerAItor application, including all features, content, and AI-powered tools (the "Service").

By downloading, installing, creating an account, or otherwise using the Service, you confirm that you are at least 13 years old, have read and understood these Terms, and agree to be bound by them. If you do not agree, do not use the Service.

Description of Service

excelerAItor is an AI-powered study tool that helps users learn from their own course materials. The Service includes:

• An AI Study Tutor powered by Anthropic's Claude model that answers questions based on uploaded materials
• Adaptive Quiz generation based on user content and performance history
• AI-generated Flashcard sets
• Progress tracking, XP, mastery scoring, and study statistics
• Material uploads (text, PDF, DOCX, and image files with OCR)
• Study planning and scheduling tools

The Service is intended for personal, educational, non-commercial use. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

User Accounts

You must create an account to access most features. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate registration information and to keep it current.

You may not share your account, allow others to use it, or use another person's account. We reserve the right to suspend or terminate accounts that violate these Terms.

Subscriptions & Billing

excelerAItor offers the following plans:

For subscriptions purchased through our website, payment is processed by Stripe. Your payment method will be charged at the start of each billing period. You authorize us to charge your payment method on a recurring basis until you cancel.

All prices are in USD. Taxes may apply depending on your location.

Apple App Store Subscriptions

If you purchase a Pro subscription through the Apple App Store, the following terms apply in addition to those above:

Cancellation & Refund Policy

Cancellation

You may cancel your subscription at any time. For web subscriptions, log in to your account and navigate to Account → Subscription, or contact support. For App Store or Google Play subscriptions, cancel through the respective platform's subscription management (see above).

Cancellation stops future charges. You retain Pro access through the end of the paid period; no partial-period refunds are issued for mid-period cancellations.

Refunds

For subscriptions purchased on our website: we offer a refund within 7 days of initial purchase if you are unsatisfied. After 7 days, all charges are final. Contact support@exceleraitor.com to request a refund.

For App Store subscriptions, refunds are governed by Apple's refund policy. For Google Play subscriptions, see Google's refund policy. We do not have the ability to issue refunds for purchases made through those platforms directly.

Account Deletion

Deleting your account cancels any active subscription and removes your personal data per our Privacy Policy. Active subscriptions purchased through the App Store or Google Play must be canceled through those platforms before deleting your account to prevent further charges.

AI-Generated Content

The AI Tutor, Adaptive Quiz, and Flashcard features are powered by Anthropic's Claude language model. These features are designed to support your learning — not to replace your course materials, instructors, or official study guides.

You acknowledge that:

• AI-generated content is not guaranteed to be accurate, complete, or current
• You should verify important information against your official course materials
• We are not responsible for academic outcomes, grades, or decisions made based on AI-generated content
• The AI may occasionally decline to answer certain questions or produce unexpected outputs

Acceptable Use

You agree not to use the Service to:

• Upload content you do not have the right to use or share
• Attempt to reverse-engineer, scrape, or extract data from the Service at scale
• Circumvent usage limits, authentication, or access controls
• Use the AI Tutor to generate content for purposes other than your own studying (e.g., to produce content for others for compensation)
• Violate any applicable law or regulation
• Upload material containing malware or designed to harm our systems
• Harass, impersonate, or harm other users

We reserve the right to suspend or terminate accounts that violate these rules without refund.

Intellectual Property

The Service, including its design, code, branding, and original content, is owned by excelerAItor and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

Your content: Materials you upload remain yours. By uploading, you grant us a limited license to process and analyze your content solely to provide the Service features you request. We do not use your uploaded study materials to train AI models or share them with third parties, except as required to operate the Service (e.g., sending content to Anthropic's API to generate a response).

AI outputs: Questions, flashcards, and tutor answers generated by the Service are provided for your personal study use. You may not resell or commercially distribute AI-generated outputs from the Service.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate. Educational outcomes depend on many factors outside our control; we make no guarantee that use of the Service will improve grades or academic performance.

Limitation of Liability

To the fullest extent permitted by applicable law, excelerAItor and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost data, lost profits, or academic harm — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $10 USD, whichever is greater.

Some jurisdictions do not allow limitations on implied warranties or liability for certain damages; in those cases, these limitations may not fully apply to you.

Termination

Either party may terminate the agreement at any time. You may close your account by contacting support. We may suspend or terminate your access for violations of these Terms, non-payment, or at our discretion with reasonable notice when possible.

Upon termination, your right to use the Service ends. Sections that by their nature should survive (AI content disclaimer, liability, intellectual property, governing law) will remain in effect.

Your Privacy

This Privacy Policy describes what information we collect, how we use it, and the choices you have. By using excelerAItor, you agree to the practices described here.

What We Collect

We do not collect payment card numbers directly — payment information is handled by Stripe (web) or the Apple/Google payment systems, subject to their respective privacy policies.

How We Use It

We use collected information to:

• Provide, operate, and improve the Service
• Process your uploaded materials through Anthropic's API to generate AI responses
• Track your subscription status and enforce plan limits
• Monitor login activity and detect suspicious or unauthorized access attempts
• Send transactional emails (account verification, billing receipts, service notices)
• Diagnose and fix bugs and performance issues
• Comply with legal obligations

We do not sell your personal data. We do not use your data for advertising or share it with data brokers.

Third-Party Services

We rely on the following third-party services to operate excelerAItor. Each has its own privacy policy:

Retention & Deletion

We retain your account data and study materials for as long as your account is active. If you delete your account, we remove your personal data from our active systems within 30 days. Anonymized, aggregated usage statistics (e.g., total questions answered) may be retained for analytical purposes.

Uploaded study materials are stored only to provide the Service to you. You can delete individual materials at any time within the app.

Login activity logs (timestamps, device type, failed attempts) are retained for 90 days for security purposes, then automatically deleted. Upon account deletion, all login history is removed immediately.

To request deletion of your account and all associated data, contact support@exceleraitor.com or use the in-app account deletion option.

Your Rights

Depending on your location, you may have the right to:

• Access — request a copy of the data we hold about you
• Correction — ask us to correct inaccurate data
• Deletion — request that we delete your personal data
• Portability — receive your data in a machine-readable format
• Opt-out — opt out of any marketing communications (we don't send any currently, but this right is yours)

To exercise any of these rights, contact support@exceleraitor.com. We will respond within 30 days.

Children's Privacy

excelerAItor is not directed to children under 13. We do not knowingly collect personal information from anyone under 13. If you believe a child under 13 has created an account, please contact us at support@exceleraitor.com and we will promptly delete the account.

Users between 13 and 18 should review these Terms with a parent or guardian.

Cookies

excelerAItor uses cookies and similar local storage technologies to operate the Service. Specifically:

• Authentication cookies — set by Supabase to keep you logged in across sessions. These are strictly necessary for the Service to function and cannot be disabled without preventing login.
• Session storage — temporary data stored in your browser during a session (e.g., current quiz state, demo mode flags) that is cleared when you close the tab.
• Local storage — used to cache your subscription tier, display name, and study preferences so the app loads correctly on return visits.

We do not use advertising cookies, tracking pixels, or third-party analytics cookies. No cookie data is sold or shared with advertisers.

You can clear cookies and local storage at any time through your browser settings. Doing so will log you out and reset any locally cached preferences. For EU users, the cookies described above fall under the "strictly necessary" category and do not require consent under ePrivacy Directive guidance; however, you retain the right to clear them at any time.

Changes to These Terms

We may update these Terms and Privacy Policy from time to time. When we do, we will update the effective date at the top of this page and, for material changes, notify you by email or in-app notice at least 14 days before the changes take effect.

Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law principles. Any dispute arising from these Terms will be resolved in the courts of North Carolina, USA, and you consent to personal jurisdiction there.

If you are located in the European Union, additional rights may apply to you under the GDPR. Contact us to exercise those rights.
